1. Introduction
Welcome to the website and services of Primex Installation ("we," "us," or "our"). By accessing or using our website, booking an appointment, or engaging our services for air conditioning installation and maintenance, you agree to be bound by these Terms & Conditions ("Terms"). If you disagree with any part of these terms, you must not access our website or use our services.
These Terms constitute a legally binding agreement between you (the "Client") and Primex Installation regarding the provision of HVAC installation, repair, and maintenance services in Berlin.
2. Scope of Services
Primex Installation provides professional climate control solutions, including but not limited to:
- Residential and commercial air conditioning installation.
- System maintenance and routine servicing.
- Emergency repair and troubleshooting.
- Ductwork design and fabrication.
- Consultation regarding energy-efficient cooling solutions.
We strive to perform all services with a high degree of professionalism and in accordance with industry standards. All work is carried out by certified technicians.
3. Client Responsibilities
To ensure the efficient and safe delivery of our services, the Client agrees to the following responsibilities:
- Access: Provide safe and unobstructed access to the installation site, both indoor and outdoor units, and electrical panels.
- Preparation: Clear the area surrounding the installation location of furniture, decorations, and other personal items. While we take precautions to protect your property, we are not liable for damage to items left in the immediate work zone.
- Information: Provide accurate information regarding property specifications, existing electrical infrastructure, and any known restrictions (e.g., homeowners association rules) at the time of booking.
- Safety: Ensure that pets and children are kept away from the work area during the technician's visit.
4. Booking and Quotations
Quotations provided by Primex Installation are valid for 30 days from the date of issue unless otherwise stated. A service is considered booked once a deposit has been paid or a confirmation has been sent via email or phone.
The final price may vary if the scope of work changes due to unforeseen circumstances discovered on-site (e.g., structural modifications, electrical upgrades, or non-standard ducting). In such cases, we will obtain your written or electronic approval before proceeding with additional costs.
5. Payment Terms
We accept the following payment methods: bank transfers, credit cards, and cash.
- Deposit: A deposit of 50% of the total quoted amount is required to confirm booking and purchase materials.
- Completion: The remaining balance is due upon successful completion of the installation or service.
- Services: For minor repairs or maintenance visits, payment is due immediately upon completion of the service.
Late payments may attract interest or suspension of warranty services until the account is settled.
6. Cancellation and Rescheduling
We understand that plans change. Please notify us as soon as possible if you need to cancel or reschedule your appointment.
- Cancellations made more than 48 hours before the scheduled appointment will receive a full refund of any deposit paid.
- Cancellations made less than 48 hours before the appointment may be subject to a cancellation fee equivalent to 20% of the quoted price to cover administrative and material holding costs.
- "No-shows" (where the technician arrives and the client is unavailable or access is denied) will be charged the full call-out fee.
7. Warranties and Guarantees
We stand behind the quality of our workmanship and the products we install.
Workmanship Warranty
Primex Installation provides a 1-year labor warranty on all installation work. This covers defects arising from improper installation. It does not cover damage caused by misuse, neglect, unauthorized modifications, or external factors (e.g., power surges, weather events).
Product Warranty
Manufacturer warranties on air conditioning units and parts vary by brand and model. We will register your warranty with the manufacturer where applicable. Any defects in materials or workmanship covered by the manufacturer will be handled directly through their warranty process, with our assistance.
8. Limitation of Liability
To the fullest extent permitted by law, Primex Installation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your use of our services or our inability to provide the services.
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
9. Health and Safety
Primex Installation is committed to maintaining a safe working environment. We adhere to all relevant German health and safety regulations regarding HVAC installation (e.g., VDI 2073, EN 378). We utilize appropriate Personal Protective Equipment (PPE) and ensure that all refrigerant handling is performed by certified personnel to prevent harm to the environment and occupants.
10. Privacy and Data Protection
Your privacy is important to us. We collect and process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws. For detailed information on how we collect, use, and protect your data, please refer to our Privacy Policy.
11. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Primex Installation or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
